Agreement to Official Rules: By participating in “The Contest”, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and/or Administrator, which are final and binding in all matters related to “The Contest”. Timing: “The Contest” begins on April 1, 2008 at 1:00 a.m. and ends on August 30, 2008 at 11:59 p.m. (“The Contest” Period). Sponsor's computer is the official time-keeping device for “The Contest”. Time is GMT/UTC - 4.

How to Enter the Sweepstakes: There is only 1 way to enter the Sweepstakes: to participate in both, the Sweepstakes and the Contest, you must register first for “The Contest”.
Register for “The Contest”: During “The Contest” Period, please visit www.dolphindiscovery.com/mydolphinexperience (the "Website"), and follow the links and instructions to complete your registration for “The Contest”. You will automatically receive one (1) entry into the drawing for the applicable Entry.

Period. Limit: Each entrant will only receive one (1) entry during “The Contest” Period for registration.
For all Submissions: Sponsor shall have the right to use, edit, and publish the winner names, in any media without attribution or compensation to the entrant, his/her successors or assigns, or any other entity.
- Contest Winner Determination: Contest winners will be determined via the process set forth below.

For each purchase, the “buyer” will have the right to suggest the number of names according to the number of swimming programs paid (1 name per 1 program)
- The “buyer" will be able to choose the name or names on his own or give someone else the chance to do so, to anyone he may consider.
- It is needed to make a brief description of the meaning of the name
- High-flown names will be invalidated
- If a reservation is cancelled, the corresponding proposed name and participant will be excluded from “The Contest”
- Through a link, each participant will be able to invite friends or relatives to vote for the proposed name(s). Votes have no cost.

Winner Selection
The winners will be selected according to the number of votes received by the proposed names. The three proposed names that obtain the higher number of votes will be the winners.
- This is a public contest and anyone will be able to see the obtained votes at any moment through the webpage
- To vote, each voter must provide a valid e-mail address, so they can’t vote more than one time from the same address, or more than one person from the same address
- Notification for Contest Winners: All Contest Winners will be notified by email or phone around September 30, 2008.

Each Dream Vacations are subject to availability and blackout dates determined by the Sponsor. Travel and accommodations are subject to availability. Sponsor will provide Dream Vacation consultation services to assist the winner in planning the details. Winner must complete the Dream Vacation within one (1) year from the drawing date or prize will be forfeited. Dream Vacation must be booked at least forty-five (45) days prior to departure. Travel must be roundtrip. Sponsor will determine airline and flight itinerary in its sole discretion. No compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in this Contest, and those set forth by the Sponsor's airline carrier of choice as detailed in the passenger ticket contract.
All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner.
Unless child of winner, travel companion(s) must be eighteen (18) years of age or older as of the date of departure and must travel on same itinerary and at the same time as the winner. If winner is a minor in his/her state of residence, the travel companion must be winner's parent/legal guardian. Winner and travel companion(s) must execute liability/publicity releases prior to issuance of travel documents. If applicable, winner and travel companion(s) are solely responsible for obtaining valid passports and any other documents necessary for international travel.
Travel restrictions, conditions and limitations may apply. If in the judgment of Sponsor air travel is not required due to winner's proximity to prize location, ground transportation will be substituted for roundtrip air travel at Sponsor's sole discretion. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. If applicable, Sponsor is not responsible if any scheduled events are delayed, postponed or cancelled for any reason, in which event that portion(s) of prize is forfeited in its entirety and no substitution will be provided except as in Sponsor's sole discretion.
- Approximate Retail Value for each prize ("ARV"): USD $ 5,500.00
- Release: By receipt of any prize, the applicable winner agrees to release and hold harmless Sponsor, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, “The Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.
- General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of “The Contest”, as determined by Sponsor in its sole discretion. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of The Contest or to be acting in violation of these Official Rules or those of any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of The Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
- Limitations of Liability: “The Released Parties” are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing errors or by any of the equipment or programming associated with or utilized in “The Contest”; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or “The Contest”; (4) technical or human error which may occur in the administration of “The Contest” or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in “The Contest” or receipt or use or misuse of any prize. Sponsor is not responsible for misdirected or undeliverable entries or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor and Administrator are not responsible for any typographical/other error in entries, selection announcement or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with “The Contest”.
- Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with “The Contest” or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering “The Contest”, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with “The Contest”, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the island of Tortola, British Virgin Islands.
